With the major amendments of the Official Text of Article 3 in 1990, conforming amendments were made to Article 4. Miscellaneous amendments were also made, as will be noted within.
This section is identical to the 1995 Official Text and has not been substantially amended since 1965. The amendments are primarily stylistic and are not meant to change the substantive law.
Article 4 of the Code contains few variations from the Official Text. Article 4 replaced and expanded on scattered provisions of the American Bankers Association Bank Collection Code, which Kansas had adopted and codified in Article 12 of Chapter 9 of the Kansas Statutes Annotated. These provisions included rules governing payment of checks after the drawer's death, payment after the drawer's incompetency, stop payment orders, rules governing forged or altered checks, and deferred posting authorization. All of these provisions are replaced by more modern versions in this Article, although Article 12 of Chapter 9 still contains a number of related provisions important in bank collections, such as deposits of minors (K.S.A. 9-1204), joint accounts (K.S.A. 9-1205), setoff (K.S.A. 9-1206), and adverse claims to deposits (K.S.A. 9-1207).
