84-2a-311. Nothing in this article prevents subordination by agreement by any person entitled to priority.
History: L. 1991, ch. 295, ยง 41; February 1, 1992.
KANSAS COMMENT, 1996
This section, which is identical to section 84-9-316, makes clear that a party with priority under the rules of Article 2A may agree to subordinate its claim. The Official Comments to this section emphasize that the rights of a person with priority may not be affected by any agreement to which the person is not a party. For discussion of what is necessary for an effective subordination agreement, see 1996 Kansas Comment to 84-9-316.
