75-53,105. Secretary access to criminal history, court records; nationwide search; fees; unauthorized disclosure, penalty. (a) As used in this section, "secretary" means the secretary for children and families or the secretary for aging and disability services.
(b) The secretary shall upon request receive from the Kansas bureau of investigation such criminal history record information in accordance with K.S.A. 2024 Supp. 22-4714, and amendments thereto, as necessary for the purpose of determining initial and continuing qualification for employment or for participation in any program administered by the secretary for the placement, safety, protection or treatment of vulnerable children or adults.
(c) Nothing in this act shall be construed to make unlawful or prohibit the disclosure of any such information in a hearing or court proceeding involving programs administered by the secretary or prohibit the disclosure of any such information to the post auditor in accordance with and subject to the provisions of the legislative post audit act.
