CASE ANNOTATIONS

1. Plaintiff must show all facts required by statute. Mo. Pac. Rly. Co. v. Hartman, 5 Kan. App. 581, 49 P. 109.

2. Railroad company is proper obligee in bond; bond not vitiated by added stipulation; liability statutory; party must show all facts required by statute. A. T. & Santa Fe Rld. Co. v. Cuthbert, 14 Kan. 212.

3. Section applies to contract for work on additions and extensions; company failing to take bond; person to whom company liable. M. Kan. & T. Rly. Co. v. Brown, 14 Kan. 557.
