65-171a. Stream pollution detrimental to animal or aquatic life. The authority of the secretary of health and environment in matters of stream pollution is hereby supplemented to include stream pollution found to be detrimental to public health or detrimental to the animal or aquatic life of the state.

CASE ANNOTATIONS

1. Health authorities may invoke remedy of injunction to prevent anticipated health menace. Dougan v. Shawnee County Comm'rs, 141 Kan. 554, 560, 43 P.2d 223.

2. Penalty for stream pollution and damage to aquatic life not allowable hereunder; action properly brought under Kansas pesticide law. Taylor v. Department of Health & Environment, 230 Kan. 283, 285, 634 P.2d 1075 (1981).
