59-2240. Demands not due. The court may allow demands, which are payable at a future day, at the then present value thereof, or the court may order the executor or administrator to retain in his or her hands sufficient funds to satisfy the same upon maturity; or if the heirs, devisees, or legatees offer to give bond to a creditor for the payment of the creditor's demand according to the terms thereof, the court may order such bond to be given in satisfaction of such demand.

CASE ANNOTATIONS

1. "Demands" include demand exhibited by surviving partner; construed; applied. In re Estate of Pratt, 164 Kan. 512, 516, 190 P.2d 872.

2. Mortgage debt, although not due, allowed as demand; will construed. In re Estate of Cline, 170 Kan. 496, 500, 227 P.2d 157.

3. Prayer of predivorce property settlement claim properly made hereunder. In re Estate of Shideler, 172 Kan. 695, 700, 242 P.2d 1057.

4. Trial court award reinstating spousal maintenance upon former spouse's death upheld. In re Estate of Dahlstorm, 26 Kan. App. 2d 664, 666, 992 P.2d 1256 (1999).
