58-3034. Title of act. K.S.A. 58-3034 through 58-3077, and K.S.A. 2023 Supp. 58-3078 through 58-3085, and amendments thereto, shall be known and may be cited as the real estate brokers' and salespersons' license act.

CASE ANNOTATIONS

1. Act not applicable to transaction involving modular home and no real estate. First Nat'l Bank of Girard v. Coykendall, 8 K.A.2d 636, 637, 664 P.2d 874 (1983).

2. Cited; violations of act may be basis of suits brought against real estate brokers. Johnson v. Geer Real Estate Co., 239 K. 324, 330, 331, 720 P.2d 660 (1986).

3. Failure of licensed real estate salesperson to state act inapplicable to sale of own home no breach of duty. Heller v. Martin, 14 K.A.2d 48, 55, 782 P.2d 1241 (1989).

4. Act held as not establishing a separate cause of action for negligent or fraudulent misrepresentation. Brunett v. Albrecht, 248 K. 634, 642, 810 P.2d 276 (1991).
