CASE ANNOTATIONS

1. Section inapplicable to investigation files of administrative agencies; applicable only to public records. Atchison, T.&S.F. Rly. Co. v. Commission on Civil Rights, 215 Kan. 911, 919, 920, 529 P.2d 666.

2. Applied; subpoena issued pursuant to K.S.A. 44-1004 for employee's records not constitutionally impermissible as violation of right to privacy. Atchison, T.&S.F. Rly. Co. v. Lopez, 216 Kan. 108, 124, 531 P.2d 455.

3. Criminal sanctions of K.S.A. 21-3827 may not be imposed for publishing information obtained from public records. State v. Stauffer Communications, Inc., 225 Kan. 540 542, 592 P.2d 891.

4. Section is a codification of common-law right of access to public records; restrictions of access to expunged records under K.S.A. 21-4619 upheld. Stephens v. Van Arsdale, 227 Kan. 676, 686, 688, 608 P.2d 972.

5. Act is applicable to corporation commission; act exempts from disclosure records specifically closed by law or by directive authorized by law. Southwestern Bell Tel. Co. v. Kansas Corporation Commission, 6 Kan. App. 2d 444, 459, 629 P.2d 1174 (1981).

6. Fire inspection records of public places are public records. City of Topeka v. Stauffer Communications, Inc., 7 Kan. App. 2d 353, 355, 358, 642 P.2d 120 (1982).

7. Computer tapes of records required to be kept by state agencies are public records; agency required to delete confidential information and to disclose nonconfidential information upon request. State ex rel. Stephan v. Harder, 230 Kan. 573, 575, 578, 579, 580, 583, 584, 641 P.2d 366 (1982).

8. Unsuccessful applicant entitled to other applicants' files, subject to deletion of personally identifiable information. Tew v. Topeka Police & Fire Civ. Serv. Comm'n, 237 Kan. 96, 102, 105, 697 P.2d 1279 (1985).
