44-521. Agreements; approval. Compensation due under this act may be settled by agreement; subject to the provisions contained in K.S.A. 44-527.

CASE ANNOTATIONS

1. Statute provides that agreement must be in form prescribed. Odrowski v. Swift & Co., 99 Kan. 163, 165, 162 P. 268 (1916).

2. Parties may agree upon amount and manner of payment of compensation. Shumona v. Armour & Co., 124 Kan. 287, 291, 259 P. 703 (1927).

3. Furnishing medical by agreement is authorized. Wolgamott v. Vinegar Hill Zinc Co., 151 Kan. 374, 377, 99 P.2d 758 (1940).

4. Forbearance to sue sufficient consideration for promise of settlement. Reed v. Kansas Postal Telegraph & Cable Co., 125 Kan. 603, 264 P. 1065 (1928).

5. Payment of substantial sum sufficient consideration for release. Odrowski v. Swift & Co., 99 Kan. 163, 166, 162 P. 268 (1916).

6. Compromise and settlement resulting in judgment of dismissal bar to another action. Pulley v. Chicago, R.I. & P. Rly. Co., 122 Kan. 269, 251 P. 1100 (1927).

7. Compensation act recognizes legality of voluntary settlement between parties. Dotson v. Manufacturing Co., 102 Kan. 248, 169 P. 1136 (1918).

8. Payments being made hereunder, demand not necessary unless payments cease. Pribbenow v. Meeker, 139 Kan. 325, 328, 31 P.2d 15 (1934).

9. Mentioned; workman's offer to arbitrate not a condition precedent to maintenance of compensation proceeding. Peschka v. Wilkinson Drilling Co., 192 Kan. 126, 128, 386 P.2d 509 (1963).

10. Oral settlement agreement not submitted to and approved by director prior to claimant's death held compensation not yet due and therefore abrogated. Barncord v. Kansas Dept. of Transportation, 4 Kan. App. 2d 368, 370, 372, 606 P.2d 501.
