22-2717. Extension of time of commitment; adjournment. If the accused is not arrested under warrant of the governor by the expiration of the time specified in the warrant or bond, a judge or magistrate may discharge him or may recommit him for a further period not to exceed sixty days, or a judge or magistrate may again take bail for his appearance and surrender, as provided in section 22-2716, but within a period not to exceed sixty days after the date of such new bond.

CASE ANNOTATIONS

1. Magistrate may grant successive continuances so long as 60-day statutory limit not exceeded. Odom v. State, 215 Kan. 456, 457, 458, 524 P.2d 217.

2. Limitations of this section and K.S.A. 22-2715 do not restrict time within which governor's warrant may be issued or executed. In re Simpson, 2 Kan. App. 2d 713, 714, 586 P.2d 1389.

3. Where petitioner awaiting extradition is being held as accommodation to counsel, release not mandatory under 18 U.S.C. 3182. Breckenridge v. Hindman, 10 Kan. App. 2d 50, 51, 54, 691 P.2d 405 (1984).

4. Where fugitive held hereunder is arrested on governor's warrant, irregularities from detention beyond 90 days became moot. In re Habeas Corpus Application of Sanders, 10 Kan. App. 2d 489, 491, 704 P.2d 386 (1985).

5. Habeas corpus denied; period of detention and extension thereof, requirements for extradition examined. In re Habeas Corpus Application of Danko, 240 Kan. 431, 435, 731 P.2d 240 (1987).

6. Detention on fugitive warrant and local charges tolls running of 90 days' commitment authorized herein and K.S.A. 22-2715. In re Habeas Corpus Application of Lane, 17 Kan. App. 2d 476, 845 P.2d 708 (1992).
