CASE ANNOTATIONS
1. In determining what constitutes a comparable offense, it is necessary to compare the elements of each offense, but the elements do not need to be identical. State v. Martinez, 50 Kan. App. 2d 1244, 338 P.3d 1236 (2014).
2. Interpretation of the Kansas sentencing guidelines act is a question of law subject to unlimited appellate review. State v. Nguyen, 304 Kan. 420, 423, 372 P.3d 1142 (2016).
3. Convictions for crimes committed before Kansas designated crimes as person or nonperson offenses are to be classified as a person or nonperson offense by referring to comparable offenses in effect on the date the defendant committed the current crime of conviction. State v. Coleman, 311 Kan. 305, 306, 460 P.3d 368 (2020).
4. Section 5 of the Kansas constitution bill of rights does not guarantee defendants the right to have a jury determine the existence of sentence-enhancing prior convictions under the revised Kansas sentencing guidelines act. State v. Albano, 313 Kan. 638, 643, 487 P.3d 750 (2021).
