CASE ANNOTATIONS

1. What constitutes established grade considered; city not liable if no established grade changed. Rinehart v. City of Concordia, 152 Kan. 473, 476, 105 P.2d 897.

2. Viaduct erected by city changed grade of street; entitlement to damages determined. Atchison Ice Co. v. City of Atchison, 172 Kan. 94, 96, 97, 238 P.2d 531.

3. Failure of city to comply with provisions of this section does not preclude aggrieved property owner from bringing inverse condemnation action on implied contract. Lux v. City of Topeka, 204 Kan. 179, 181, 183, 460 P.2d 541.
