CASE ANNOTATIONS

1. Applied; failure to allege intent to defraud in prosecution under K.S.A. 21-3702 held error. State v. Giddings, 216 Kan. 14, 18, 531 P.2d 445.

2. Section is constitutional and valid; creates a permissible presumption. State v. Smith, 223 Kan. 192, 193, 194, 195, 196, 573 P.2d 985.

3. Instructions on intent as shifting burden of proof on credibility of testimony as violating due process, examined. State v. DeVries, 13 Kan. App. 2d 609, 780 P.2d 1118 (1989).

4. Child abuse (K.S.A. 21-3609) and aggravated battery (K.S.A. 21-3414) as separate rather than merged crimes examined. State v. Young, 14 Kan. App. 2d 21, 30, 784 P.2d 366 (1989).
