16a-2-309. A licensee may conduct the business of making loans under K.S.A. 16a-1-101 et seq., and amendments thereto, within any office, room or place of business in which any other business is solicited or engaged in or in association or conjunction therewith, unless the administrator finds that the other business is of such nature that such conduct tends to conceal a violation of this act or of the rules and regulations made thereunder and shall order such licensee in writing to desist from such conduct.
History: L. 1973, ch. 85, § 26; L. 1998, ch. 106, § 3; L. 2024, ch. 6, § 47; January 1, 2025.
KANSAS COMMENT, 2000
This section allows a licensed lender to make supervised loans through a separate office located in a retail store unless the administrator finds that the arrangement would tend to conceal evasion of the U3C. An example of an operation which might be shut down by the administrator under this section is a loan office in a dealer's place of business to which credit buyers are referred in order to insulate the lender from defenses of the consumer. See K.S.A. 16a-3-405.
